Judge Leon of D.C. District Court ordered the release of Lakhar Boumediene, of the eponymous Supreme Court case, and four of his colleagues. Haven’t read the opinion, but apparently Leon read his opinion from the bench upon conclusion of arguments – quick turnaround – and urged the government not to appeal. Ahem: the government certainly will appeal, and it will be a live issue when the Obama administration comes in. A quick way to judge his attorney general, then, will be to see what he’s going to do about it.
